Terms of Service (Public Offer and User Agreement)

1. General Provisions

1.1. These Terms of Service (“Terms”) govern the use of the website TOGETHER HUMAN (“Website”) and the purchase of goods offered through the Website.

1.2. The Website is operated by TOGETHER HUMAN, located in Germany, (“Seller”, “we”, “us”).

1.3. By using the Website or placing an order, the User (“Customer”, “you”) accepts these Terms.

1.4. If the Customer does not agree with the Terms, they must stop using the Website.


2. Subject of the Agreement

2.1. The Seller offers handmade goods, including but not limited to toys, books, mugs, trays, home décor and related items.

2.2. The Customer can browse the Website, place orders and purchase products in accordance with these Terms.

2.3. The Seller reserves the right to update, modify or discontinue any part of the Website or product offering at any time without prior notice.


3. Eligibility

3.1. To place an order, the Customer must be at least 18 years old or have parental consent.

3.2. Customers are responsible for ensuring that the purchase and import of goods is permitted in their jurisdiction.


4. Product Information

4.1. All products are handmade; therefore, slight variations in color, size or texture may occur. These are not considered defects.

4.2. Product descriptions, images and specifications are provided for informational purposes. Actual appearance may differ due to screen settings or individual craftsmanship.

4.3. The Seller is not responsible for typographical or pricing errors on the Website. If such an error occurs, we may cancel the order and refund the Customer.


5. Prices and Payment

5.1. All prices are listed in EUR, including VAT where applicable.

5.2. Payment methods may include:
  • credit/debit cards;
  • PayPal;
  • Klarna;
  • bank transfer;
  • other methods displayed at checkout.

5.3. The order is processed only after full payment is received.

5.4. The Seller does not store or process payment card data; all payments are handled by certified payment providers.


6. Order Process

6.1. By placing an order, the Customer submits a binding offer to purchase goods.

6.2. The Seller accepts the order once an order confirmation is sent to the Customer via email.

6.3. The Seller may decline or cancel an order for legitimate reasons (e.g., insufficient stock, incorrect address, payment issues).


7. Shipping and Delivery

7.1. The Seller ships from Germany to both domestic and international destinations.

7.2. Shipping costs and delivery times are shown at checkout and may vary depending on location.

7.3. The Seller is not responsible for delays caused by carriers, customs or force majeure events.

7.4. International Customers are responsible for customs duties, import taxes and any local fees.


8. Right of Withdrawal (EU Customers)

8.1. Consumers within the EU have the right to withdraw from the contract within 14 days without giving reasons in accordance with Directive 2011/83/EU.

8.2. The withdrawal period runs for 14 days from the day the Customer receives the goods.

8.3. To exercise the right of withdrawal, the Customer must send an explicit statement (email is sufficient) to the Seller.

8.4. Items must be returned unused and in original condition.

8.5. The Customer bears the return shipping costs unless otherwise stated.

8.6. Exceptions to the withdrawal right include:
  • custom-made or personalised items;
  • items which cannot be returned for hygiene or safety reasons once opened.


9. Returns & Refunds

9.1. If the Customer receives a damaged or defective item, they must notify the Seller within 7 days of delivery with photos of the issue.

9.2. The Seller may offer a replacement, repair, store credit or refund depending on the situation.

9.3. Refunds are issued to the original payment method.


10. International Delivery Terms

10.1. International delivery times vary by destination and cannot be guaranteed.

10.2. Customs clearance may delay delivery beyond estimated timeframes.

10.3. The Customer is solely responsible for import duties, taxes, brokerage fees and any other customs-related charges.

10.4. The Seller is not responsible for returns or loss of packages caused by customs refusal, unpaid duties, or incorrect recipient information.

10.5. If a package is returned to the Seller due to unpaid customs fees or incorrect address, the Seller may deduct shipping costs from any refund.


11. Intellectual Property

11.1. All content on the Website (images, text, designs, graphics, products) is the property of the Seller or licensed to the Seller.

11.2. No part of the Website may be copied, distributed or used for commercial purposes without prior written permission.


12. Limitation of Liability

12.1. The Seller is not liable for indirect, incidental or consequential damages.

12.2. Handmade items may contain small parts; Customers must ensure safe use and keep items away from children if necessary.

12.3. The total liability of the Seller shall not exceed the purchase price of the product.


13. Governing Law & Disputes

13.1. These Terms are governed by the laws of Germany.

13.2. Disputes shall be resolved in the competent courts of the Seller’s place of business, unless mandatory consumer protection rules specify otherwise.
